Drunk Driver Gives Up During Sobriety Test

Tells officers his last drink was hours ago, then admits it was about 10 minutes before he was pulled over.

Swerving over the center line and weaving back and forth while driving can be a red flag to police, as one man discovered early Saturday morning.

About 1:30 a.m., Fox Point police pulled over a 24-year-old Germantown man after he demonstrated reckless driving.

The man began by crossing over the center line on North Port Washington Road. He then came to complete stop at a flashing yellow light. Police decided it was time to take action.

An officer noted in his report that he could smell alcohol on the man's breath and his eyes were bloodshot and glassy. The officer asked if the man had been drinking, and he replied, "Only two vodka drinks at a bar." The man claimed he had been downtown drinking and said his last drink was at 11:22 p.m.

The officer asked how he remembered that particular time so clearly, and the man said that he “remembers things like that.” While speaking with driver police observed a half-empty bottle of Gordon’s vodka sitting on the passenger seat. The man was swaying back and forth considerably the entire time he was speaking to police.

During the field sobriety test, he began hopping up and down to maintain his balance, and then placed his foot down after the leg stand test, unable to balance for the required time. He said to police, “Yeah, you got me,” and refused to continue the test. He then admitted to the officer that he really had last drink about 10 minutes prior to being pulled over.

He registered a 0.22 blood alcohol content on a breath test and was arrested.
