Officers pulled the car over and as soon as they began speaking, police noticed the driver had a recently lit cigarette, which the officer believed was an attempt to cover up the smell of alcohol. The driver said he was coming from a friends house on the East Side of Milwaukee. His eyes were glassy so police asked him to recite the alphabet, to which he gave his own version, "EFGLMNQRST."

During the walk and turn test, he was noticibly swaying. He voluntarily completed the preliminary breath test, which showed a blood alcohol content of 0.129. He was arrested and cited for absolute sobriety and operating with prohibited alcohol concentration. He was released to his mother at 4:30 a.m.
