After the driver was arrested for OWI, the passenger, his brother, admitted to drinking that evening as well and was sent to the Open Pantry to wait for a ride home.
Two men driving a white Jeep were seen swerving on Interstate 43 near Brown Deer Road and caught the attention of Bayside Police early Nov. 17. Police pulled the car over on North Port Washington Road. As the officer spoke with the 23-year-old driver, he noticed the man’s eyes were glassy and his speech was slurred. He could also smell alcohol on the man’s breathe as well as from inside the car. The officer asked the man for his driver’s license and whether or not he had been drinking earlier that night. Surveillance footage showed a man try twice to pump gas at the Open Pantry, then drive off when he was denied without prepayment. The footage blew up the story that he wasn't driving the car.
A 29-year-old Milwaukee man had a run-in with Bayside Police, whose attempts at pumping gas at Open Pantry led to a citation for operating without a license. An Open Pantry employee called Bayside Police at 1:15 a.m. Nov. 12 to report a gas drive-off. When officers arrived, the employee said a man had driven to the gas station on two occasions that night, then left after the employee told the man he would have to prepay for gas because his car only had a temporary license plate, the police report said. Police found a car matching the description the employee gave sitting on the side of the road in the 9100 block of North Port Washington Road. The convenience store giant is purchasing every Open Pantry in the nation, including the one inside the BP gas station on the corner of Brown Deer and Port Washington Roads but it's unclear if this store will remain an Open Pantry or become a 7-Eleven.

Police caught up with him at his home and escorted him back to the gas station to pay for the $20 of gas he ran off with.
Bayside Police were called to Open Pantry for a gas drive off but what the the thief didn't know is officers would soon be paying him a visit at his home. Just before 10 a.m. on May 29, police came to the gas station and spoke with an employee who was able to provide a license plate number for the car that drove off with the five gallons of gas. Police traced that number to the registered owner in River Hills. Police went to the man’s house and a matching vehicle was in the driveway with a man waslking into the garage. They asked him if he had just purchased gas at the Open Pantry. He said yes, but could not provide a receipt for the credit card purchase he claimed he made. A 22-year-old Fox Point man was arrested for OWI outside the Open Pantry after a store clerk called in about an impaired driver returning for a second time. The man and his 18-year-old male passenger offered no explanation for the pile of stuff outside his car — including condoms and energy drinks. Milwaukee man charged with his third OWI after police find him filling up at Open Pantry smelling more like alcohol than gasoline.
A 41-year-old Milwaukee man is facing drunk driving charges after he was caught filling up his gas tank in Bayside while drunk. Eduard Feldman was charged in Milwaukee County Circuit Court Monday with one count of third offense operating while intoxicated and one count of operating a motor vehicle with a prohibited alcohol concentration. If convicted, he faces up to one year in county jail and $2,000 in fines. According to the criminal complaint: Bayside police were called to Open Pantry Monday on report of a reckless driver, where they found Feldman filling up his gas tank. Store loses $11.14 but thief used a credit card and police are investigating.
Bayside Police are searching for two women who stole a handful of snacks from the Open Pantry. According to the report: The clerk on duty told Bayside police two women, who appared to be between 18 and 25 years old, came into the Open Pantry and stuffed several bags of snacks under their jackets and left after only paying for two sodas. After reviewing the security tapes, the manager determined the women stole: The total loss to the store was $11.14. The suspect paid for the sodas with a credit card and police are investigating the theft.

The Open Pantry was the scene of yet another crime Sunday night, just before 10 p.m. when three juveniles tried to rob the store. According to the report: Two teens came into the store and an employee asked if he could help them find anything. One of the suspects said "Symphony candy bars." Instantly, one of them grabbed a box of King Size Reeses Peanut Butter Cups (the box was about ½ full and has a retail value $20 to $30), and they ran out the door to a maroon van. Even with slurred speech, glassy eyes and bad breath, this guy swore to officers he was sober.
An Open Pantry employee called Bayside police after a man circled through the parking lot not once, twice, or even three times — but four times. Just before 2 a.m. Dec. 26, officers found the 30-year-old man who ran a red arrow light at Brown Deer Road and Port Washington Road matching the description from the Open Pantry employee.
